WARNING TO COMPETITOR USING NAME SIMILAR TO YOUR CORPORATE NAME

Dear Felix

We are a corporation who has been operating under the name [NAME OF CORPORATION, ex. Acme Computer Solutions Inc.] since [DATE OF USE OF NAME, ex. September 12, 1988].

We have learned that you have been using the name [NAME USED BY COMPETITOR, ex. Acme Computer Consultants Inc.] since [DATE OF USE OF NAME, ex. October 15, 1997].

In view of the fact that we have had first use of the name Acme Computer in association with computer systems, your use of the name is unlawful and infringes on our trade name and goodwill.

You are hereby required to immediately cease and desist use of the name Acme Computer. In the event that we do not receive from you satisfactory evidence that you have ceased using this name, and have disposed of, altered or destroyed all supplies, materials and other corporate assets using the name Acme Computer, within thirty (30) days of the date of this letter, we will have no recourse but to refer this matter to our legal counsel to commence legal proceedings against you to enforce our rights.

Kindly govern yourself accordingly.
